현대 정치에서 헌법과 정치는 상호 규정적인 역동적인 관계를 형성하고 있다. 한 사회의 정치과정을 온전히 이해하기 위해서는 일상적인 정치과정을 규제하는 헌법의 성격과 내용을 이해할 필요가 있고, 역으로 헌법의 성격과 한계를 온전히 이해하기 위해서는 헌법이 수립된 정치과정과 헌법에 반영된 정치공동체의 기본 가치들이 무엇인지를 이해할 필요가 있다. 한 국가사회의 기본 가치와 기본권 사항 그리고 권력분립에 관한 핵심 원칙들을 담고 있는 헌법은 일상적인 정치과정을 규제하기 때문에 정치 위에 군림하는 듯 보이지만, 보다 근본적인 수준에서 정치는 건국이나 혁명 혹은 급격한 사회변혁의 시기에 한 국가사회를 위한 공존의 기본 틀, 곧, 헌법을 수립하거나 수정하는 집단적인 결정을 내린다는 점에서 헌법의 근원이기도 한다. 따라서 ‘헌법과 정치’ 과목은 정치의 이중적인 측면, 곧 헌법에 의해 규제되는 일상정치와 헌법을 구성․수정하는 헌법정치라는 양 측면의 상호 규정적인 관계를 다룰 뿐만 아니라, 한국 헌법에서 정치적 의미가 현저한 조항들을 설명함으로써 한국헌법에 대한 이해는 물론 정치과정에 대한 이해를 심화시킨다. 헌법의 의미와 종류, 헌법해석론, 기본권 사항, 권력분립 원칙, 그리고 대한민국의 정치적 가치를 표현하는 자유주의, 민주주의 그리고 공화주의 및 이들 사이의 조화로운 통합 문제 등은 이 과목에서 다뤄지는 핵심적인 주제들이다.

This lecture deals with the dynamic interrelationship between constitution and politics, which has been one of the most important theoretical issues in modern political theory. While it is  necessary to understand the fundamental characteristics and contents of the constitutional law of a country in order to shed proper light on the nature and procedural characteristics of its politics, it is also necessary to understand both the historical political process through which the relevant people established the constitution and the basic common values reflected in the constitution in order to understand the characteristics and the limits of the constitution. In this general theoretical framework, the following topics are specifically dealt with: the meaning and the kinds of constitution, theories of constitutional interpretation, basic rights, the separation of power, the interrelationship among constitutive political ideologies of Korean constitution and their harmonious integration and so on.
